Chapter 8.12. ABATEMENT OF SUBSTANDARD BUILDINGS AND PROPERTY |
§ 8.12.010. Findings.
The city council does find, determine and declare as follows:
A.
1.
That this city has a history and reputation for well-kept properties and strict enforcement of zoning restrictions and building regulations,
2.
That the general welfare of this community is founded upon the appearance and maintenance of properties; and
B.
That there now appears to be need for further emphasis on the maintenance of a number of premises in that certain conditions, which appear to constitute nuisances, as hereinafter set forth, have been found from place-to-place throughout the city; and
C.
1.
That the existence of property in a condition constituting a nuisance, as hereinafter defined, is injurious and inimical to the public health, safety and welfare of the residents of this city and contributes substantially and increasingly to the problems of, and the necessity for excessive and disproportionate expenditures for protection against hazards, prevention of crime, and the preservation of the public health, safety and the maintaining of adequate police, fire and accident protection,
2.
That such problems are becoming increasingly direct and substantial in significance and effect; and
D.
That the uses and abuses of property, as described herein, reasonably relate to the proper exercise of the police power in protecting the health, safety or welfare of the public, and are authorized by Sections 65800 et seq., Section 38660, Sections 38771 et seq., and Sections 39501 et seq., of the California Government Code, and by Article 11, Section 7 of the California Constitution; and
E.
1.
That unless corrective measures are undertaken to alleviate such existing conditions, and particularly to avoid future problems in this regard, the public health, safety and general welfare, and social and economic standards of this community will be depreciated;
2.
That the abatement of such conditions will enhance the appearance of such properties; and
F.
That the abatement procedures set forth in this chapter are reasonable and afford a maximum of due process and procedural guarantees.
