§ 17.64.010. Nonconforming residential structures.

  • Where residential structures in the districts are not in conformity with the provisions of this title, they shall be subject to the following standards:

    A.

    Purpose. Where structures are nonconforming, it is the intent and purpose of this section to allow such structures to continue provided they are maintained with similar types of materials.

    B.

    Nonconforming Structure Regulations. All nonconforming structures shall be subject to the following regulations:

    1.

    Any nonconforming structure shall be allowed to continue provided the structure is compatible with the uses permitted in the district in which it is located and does not contain a nonconforming use as described in Section 17.64.020.

    2.

    Any nonconforming structure as described in subsection A of this section, shall be maintained with materials of a type similar to the original construction.

    3.

    A nonconforming structure may remain subject to the regulations set forth in this section and Section 17.64.020 provided no additions or enlargements are made thereto and no structural alterations are made therein, except those required by law or ordinance, or required for the maintenance of the nonconforming structure. If the nonconforming structure is removed, every future use of the premises shall be in conformity with the provisions of this title.

    4.

    If the nonconforming structure is destroyed by fire, explosion, natural disaster or act of God, subsequent to the date of adoption of this title, wherein the cost of reconstructing, repairing or rebuilding the structure exceeds fifty percent of the reasonable replacement value, the structure shall be constructed to meet all standards of the district in which it is located.
